Makes sense to me that a cut off must exist.

my situation is 2009 to 2011 , first two years
zero sum , no SISIP during two years
getting retro for it.
Also appealing for LTD beyond first two years which is 2011 to 2013 , so I just wanted to find out the legal fees situation for retro past July 2012.

firebird, I am not 100% sure, but I do believe there is a set time frame limit, put in place for us to use the adjudicator. If you don't already know you should check it out.

I was told 90 days to appeal through SISIP , not sure how many days with MC but I have sent them an email requesting an appeal through the adjudicator.

In the proposal it states that the zero sum member shall have 90 days to appeal to the adjudicator.

Does anyone know when the 90 days starts to use the adjudicator? Is it from when SISIP made a decision on your claim or a date set by MC? Also is there a fee to go through the adjudicator or is MC paying for it because if the appeal is denied then there will be no legal fees for MC?

I would call MC tomorrow, to confirm that your appeal has been registered. I would think that the 90 days starts the day the judge sign the order. There is no fee for the adjudicator

I just received my decision last week , not TPI and I am zero sum. So through SISIP I have 90 days from that date. When did the Judge sign the order? I require time to get paperwork filled out by my family Doctor.

The final order was signed by the Judge April 15th 2013. Best of luck to you. One word of advice when you meet with your doctor. Make sure you explain the circumstances to hm or her, and maybe bring the denial TPI letter from sisip in to discuss. Ask your doctor for their support, and be up front with your doctor. The adjudicator should also be helpful in guiding you through the appeal.
