Taking VAC to Federal Court

Post by Skud on Thu 03 Dec 2015, 16:13

Just an FYI

Having a lawyer represent you/us paid for, is now in a "holding pattern". According to BPA this was Something the Conservative government came up with.
No decision as of yet......unless someone has other info or heard otherwise?

http://thechronicleherald.ca/editorials/1300569-editorial-disability-victory-for-vets
Paragraph 8

"The 2015 report referred to a three-year-old recommendation that Ottawa is finally addressing. Veterans Affairs Minister Erin O’Toole announced last week that the federal government will fund veterans’ pension appeals all the way to the Federal Court. Until now, only appeals as far as the VRAB had been funded by Ottawa; veterans who appealed to the Federal Court had to hire a lawyer, find a pro bono one or represent themselves in court."

Also there was a post on it on the forums Here..

JMO Skud and not to put you out of context either, however.
"  According to BPA  this was Something the Conservative government came up with. "?
How valid is that historical conservative initiative in the here and now and it's merits of some "holding pattern" of the future to begin with?
To me it's just circular, cheap, self-serving bs

OK talked to the OVO today about this and this is the answer on wether it's dead in the water or not....

No it is not. Our Office is still pushing for this to happen. It is
one of our recommendations from the VRAB report. It is dead in the
sense that obviously the Conservatives are not going to be pursing this.
Our follow-up report on VRAB
http://www.ombudsman-veterans.gc.ca/eng/reports/reports-reviews/vrab-followup-report#ead
released in Feb of this year still has the recommendation (#5). We
will continue to push for it.

So it's time to push the new MVA and PMT to follow thru on this.
