Anyone want to take this one on?

My disability percentage is 110%.

So how do I go about starting the process in getting the legislation
changed?

A reassessment will not result in a financial increase as I am
over 100% now. I received my 20% award before I received my increase
percentage of my disability pension. Therefore the most my pension
can be is 80% , 100% minus 20% award. However my pension total
is 90% but I can not get 90% as the most that I can get for a
pension is 80% so I am losing 10% every month for the last several years. This I disagree with
as I think that the two should be separate , 100% for pension
and 100% for awards as two are on the old charter and one is
on the new charter.

They are right, unless they change the legislation so that each disability is assessed and awarded individually, or get rid of percentages altogether, paying preset amounts based on symptoms, there is very little that can be done. The only possible avenue might be a judicial review of the lawfulness of a decision that compensation for a disability cannot be paid out because of previous payments for other unrelated disabilities, just because they happened to total 100%.

my pension percentage increased after I received an award because it was under assessed but I could not get the full percentage increase because of the award amount. I am young so 10% a month for 30 to 35 years is a great financial loss. Had I have known that my pension percentage was going to go up I would not have put a claim in under the new charter.

Firebird, I am in the same situation as you.
It'll take an act of parliament to fix this!
