Hey everyone, how are you all? So is this latest refund based on the gross refund amount or net??? THere is quite a difference..money in the bank anyway it works out. Also does the adjustment to our monthly LTD start right away after the court approves it in Jun 2014 or is it Jan 2015 as it appears our refunds start to go out?? Any help would be much appreciated..
Hope this text finds you all well..Frankie AKA Sue

Hey Teen I used no dirty words other than "dirty" itself lol and yup the ole saying "Clear as Mud" brother because I ain't doing this shyte again. I was told it was the way Rex explained it but then I was told that was way to simple, then I sent this out and was told What The Fack is that, and this guy is a lawyer you go figure. So in a simple tone "I GIVE UP" . Night Irene

The policy did change some in 1999, but the amount of coverage always stayed at 75% of gross salary for LTD.

Had to go look at the contract on SISIP's site to confirm.

Not sure how they came to 74% for calculation.

On the gross settlement that is almost $400K missing.

THE 74 percent as nothing to do with the Sisip policy, it means we will receive 74 percent of the amount owed to us out of the 100 percent as said in para 2. For the years mentionned in para 1.

1. Adjustments to cost of living were applied each year , except for the years 2002, 2004 and 2007.
2 . All members will receive 74 % of the amount due to them for the years mentioned in paragraph 1.

Again, not to clear!

I'm trying to figure out why are those years singled out? Are all the other years getting at 100% of what is owing? Was it only those 3 years that were short-changed? If SISIP calculated CPI based on the reduced amounts, then it we should be paid 100% of what they shorted us of, for every year. To me, this ambiguity is significant, because I was only on SISIP for 2006-2007, and since SISIP's payment at the time only accounted for roughly 16% of my pre-release pay, the actual meaning of these sentences could greatly reduce or increase any money that I will receive.

Either way, I'm not going to make very much, but several hundred in my pocket, is better than several hundred sitting in the Government coffers.

I did a better part of the math and figured it would be much closer. The original, I believe $887 million divided by the amount I received, then I multiplied amour to the allotted funds that we have just been approved for. You get my meaning, how can you go wrong. For example; $100.00 allotted and and I receive $20 = 5%, new approved mount from judge = $20.00 x 5% (I would be receiving $1.00) Simple math

It means that he is going to take the settlement, read it over, compare it to other case law, and then give his decision. Basically, it is the legal term for making up his mind.
