ELB CLASS ACTION LAW SUIT

I hope I can make it happen for those who come behind me too sailor964..I wont go gently into the night on this I can promise you that..hopefully harper is so beat to crap after his week off to hug his buddies in Calgary he wants to pay back the money they stole in front of the cameras..SMILE.....................

First of all I agree with Meteck. I just finished a college course for administrative specialist. My daughter also did a course for veteranian assistant. Each course was almost a year in length. For the most part it was ok. What I have noticed was that the quality of students were being pushed through like wildfire. Some of them with no common sense. When i asked about the possibility for my daughter to find a job with her specifics the answer was not what i expected. Turns out they inflate there numbers on there site when it comes to percentage for future employment. Right now i find it very difficult for me to obtain employment even with my background. I hope something does happen for you meteck.

brasidas I have my entire file now in front of a very solid member of the ombudsmans office. I have a case worker who truly gives a crap. ethe nough to run this up the pole on my behalf. I will need to make my case and if I do it properly my hope is that in future facilitators like march of dimes is no longer sucking in free money to do squat for the client. and to open up the max dollar for ANYONE,REGARDLESS OF RANK OR FORMER EDUCATION. the perception that a 3 ringer because he already had a university education and an income far larger than a poor grunt Cpl is entitled to max dollars to re-educate unfairly paints the grunt as a less smart person therefore college would do..horseshit. we all know that the military was full of uber smart ncms that didn't roll the officer suit well so decided to work for a living. to put us through this program with false data and unrealistic expectations of what this education will do finalcially when completed. I know with my college certificate I can pay 400 bucks and register with the provincial body that makes me certified..problem is EVERY JOB up for grabs requires your BA. minimum..so waste 20 grand or be successful with 70 grand..the 50 grand diference is 18 months projected salary..thats what I have to prove.i win and others with little rank but big brains can go train for a real career..ill keep you informed ..and BIG REX I really hope your rightcause if nov11 comes and gos with no speech I feel we are in for a very long haul indeed.

Meteck I hope you get something out of all this. If you manage to get a quality education you will be very lucky. I wonder if getting a bunch of stories about how useless the education was for most of us will help your case.

meteck, I would not worry too much about the lack of info from the department about the retro. We all know that this government is so secretive that it makes the CIA look like a community awareness group. There are probably orders down from the PMO that nothing can be said until Harper says so, with a public news conference, likely in the days leading up to Nov 11. The Tories will try to deflect all the current criticism of their closing the VAC offices and the legal stalling of the Equitas lawsuit, before they have to stand out in public with Veterans from across the entire country at Remembrance days ceremonies. But unlike Chretien, they are likely worried about getting more than just a pie thrown at them.

brasidas I do just that..got a call from va yesterday..no new news on the clawback..none......zippo..............nada............its not a good sign..got a letter from Julian fantino as well..never makes mention of my clawback question....not good.....on a good note the ombudsmans office has taken up my case for futher education for mcpl and below who cant get funding for a university education..have a review scheduled in 2 weeks with top dogs at va...gotta make my case right as I am the test case for the new changes to the new veterans charter made oct 1...if it works for me it will open the door for non-officers to get a quality education not some dinky course that will have you ending up working at mcdonalds.

I have beenon phone with ombudmans office all morning.. told them all there wonderful changes to elb program did nothing for me. was very upset but actually got a call back and they are with my permission going to find out why I don't qualify for all this education money they have out there, I explained that this money was there for ivrp plans that help a dentist or doctor who made great coin before the program the ability to go to university so they don't slip down the money ladder. makes me so mad..anyways they told me that as of oct1 2013 things like internet and parking and crap are being paid and the internet has risen from the 25 a month it used to be. hopefully ill get some answers and find out why us poor college dummies cant have a crack at university and a real chance at a job!!fightin the good fight!

I think I understand what is being said. Because the effective date of the change is Oct 1 of this year, so if a Veteran in receipt of WVA for several years requested a reassessment of a pensioned condition before Oct 01 , 2013, but approved afterwards, any retro active amounts for the time period before Oct 1st will still be considered to create an overpayment of WVA. This overpayment will be deducted from the retro active lump sum amount, and if for some reason there is still any amount owing, it will be deducted from future payments until paid off.

Jack and bruce, it truly is a confusing statement because there are no longer new disability pensions granted, and there are no retro active components in the NVC. So this section will only affect those that are currently waiting for a decision on a reassessment of an existing PA pensioned disability. But then again, if the calculations of the WVA are done without the PA included, then an increase in the PA, should not affect the calculations, and create an overpayment situation. So to me this clause is completely useless.

The section of the PA they refer to states this:

"If any person who is or has been in receipt of relief or unemployment assistance from the Department is or has been awarded a retroactive pension or a retroactive increase of pension, the difference between the amount actually paid by the Department and the amount that would have been paid if the retroactive pension or the retroactive increase of pension had been payable when the relief or unemployment assistance was issued shall be a second charge on the accumulated unpaid instalments of the pension and shall be withheld accordingly, subject to the payments to be made, as a first charge, to a province pursuant to subsection 30(2)."

Since it has been deemed wrongful for the PA pension to be used in the calculations of income assistance plans, this subsection can no longer be applied.

The only thing that worries me is that they fixed the coming into force date as Oct 01, 2013, even though they announced the change in June of 2012, so that there can be no retro active WVA payments. I understand that this change required a change in the actual legislation, not just the regulations, and thus the delay, but they could have still have changed the coming into force date to the date of the announcement at least. This is just another half-assed attempt by the Tories to make Veterans, and the public, think that they care about Veteran's welfare, without actually loosening the purse strings enough to do it properly.

Brigitte my reference was to a phone conversation with SISIP last month.

To further explain why the LTD retro has to be done first. Since last May any announcement about SISIP LTD (insurance given to veterans before 2006 which is the birth of the NVC) ELB (VAC's replacement for SISIP LTD) was always 30-60 days behind after the LTD was done.

For example reinstating LTD last Septemeber. ELB was reinstated last October/November. In other words the class action lawsuit has to be taken care of first then the NVC follows suit.

Don't ask me why because personally I don't understand it. LTD is a DND program and ELB is a VAC program. Two different departments which are allowed to do separate things.
