Entitlements on separations

Question when your are getting a separation.

Is your spouse entitled to some of my VAC pension?
Also will she be able to get some of my ltd pension?

I have no kids and my wife works full time

Yes your spouse is entitled to some of your VAC and LTD.

But this depends on what you agree on from your separation. If it's verbal, then you make your agreement between yourselves, if it goes through the legal process, then both lawyers will agree on a legal separation agreement.

There's spousal support, and child support or both depending on whether you have kids under your care. Spousal support has it's own set process for determination and child support is determined on the number of children you have, and province they live in.

I just noticed you put down you have no kids, so no child support payments.

If your wife is working full time, then she will have to obtain a lawyer to go after spousal support, that sometimes could be a challenge to get approved for spousal support if she is working full time. But how long you've been married and how secure is her job are factors that come into play.

If the lawyers get involved, then it will cost both parties.

DCHD27- ya sorry to hear, if you get CF pension, 1/2 for her of your years she was with you when you where in. Mine was 1/2 of 17 yrs , and oh it still stings every mth yrs later..lol , Johnny out VVV...

It also matters what types of benefits you actually receive from VAC. A PA disability pension cannot be assigned for anything, other than child support. I would say, that she should be entitled to the portion of the PA pension designated for the spouse (currently maxed at $683/Mo), but I believe that portion is ceased when you get divorced. I'm not sure about NVC benefits, such as PIA and PIAS, but she would likely be entitled to a portion of any ELB or SISIP payment, as well as your CF pension. There may be some other members who have unfortunately have gone through the process, who can offer more guidance.
